Introduction to Chinese Law


This guide includes links to many of the best websites for finding information about the laws and legal system of the People's Republic of China (PRC). It also includes links to websites covering China's business, political & legal culture.

All Hastings faculty and students have access to both iSinolaw* and LawInfoChina**.

These two subscription databases provide excellent access to Chinese laws and regulations. Each includes the Chinese language version of the law and useful English translations. With these two subscription sources and several free Chinese law databases, one can have reasonable confidence that they have the most relevant laws and regulations available on a specific topic.

This research guide also includes information about how to find books and articles on Chinese legal issues.

  • China Law Digest is a bilingual, monthly online resource detailing the latest news and developments on contemporary Chinese law and legal scholarship. The purpose of this website is to offer the latest news on legal developments and judicial reform to domestic and foreign subscribers interested in Chinese legal issues. Find Books

Finding Chinese Law Books at Hastings

If you can find a few good books covering your topic, it can make your research much easier. Hastings has a good collection of books on Chinese law. For an even wider selection of available books, search the sources below to see if other libraries have books you can borrow through inter-library loan.

To find books at Hastings use the new Encore catalog or the Classic catalog, Encore allows you to do a quick one-box search to find books at Hastings and articles available through Hein-Online. The advanced search feature allows more complex title, author and subject searching.

Browsing For Books

If you find a book that looks interesting, and you are not on campus, click on the call number to browse titles on the shelf nearby. Of course, if you are on campus, browsing the shelves is a great way to find relevant books. Most of the Chinese Law books are on the 6th floor in the KNX call number range.

Borrow Books Through Inter-Library loan

For a wider selection of available books, search to see if other libraries have books you can borrow through inter-library loan. If the book you want is not in the Hastings Library, or you would like to locate other books on your topic, use FirstSearch, a database containing information about books from most of the libraries in the English-speaking world. Search the WorldCat database to find book; click on the ILL icon at the top of the page to request the book.

Google Books

Use Google Books to search a wide variety of books. You may have an option to view the contents of the book, but often online access is very limited.

Find Articles


Finding Articles in Lexis, Westlaw & Hein Online

Sometimes law review articles can be one of the best places to find current research on your topic. Lexis, Westlaw, Legal Scholarship Network & Hein Online are all good sources for law journal articles.

Although there is a lot of overlap on Lexis and Westlaw, you will find some articles unique to one database or the other. By searching both Lexis & Westlaw you will cover most of the law review articles written since the mid-1990s. If you have a citation to an law review article that is not on Westlaw or Lexis (and is older than the last year or two), you will probably be able to print a PDF version of the article from Hein Online. For working papers, unpublished research, and recently published articles the Legal Scholarship Network is a good resource.

You can search a large number of law and social science journals using Google Scholar. Oftentimes, you can get access to the full-text, but not always.

Search Legal Periodicals Indexes

If you are having difficulty finding relevant articles, you can search the following periodical indexes. These searches are only for the title or abstract of the article, these are NOT FULL-TEXT searches.

About Legal Periodical Indexes

Unlike Lexis and Westlaw full-text law review databases, legal periodical indexes include almost every U.S. law review article from 1980 to present. Therefore, one advantage to searching these indexes is that it allows you to search more journal articles. Another advantage is when you receive too many irrelevant results from your full-text searches. If this is the case, an index search may give you better results since you are not searching the full-text of each article. Also, if you are interested in historical research, articles published between 1918 and 1980 are only searchable using an index. Select "Legal Periodicals Retro" when searching the Index to Legal Periodicals & Books for these older articles.

What to Do After Finding An Article In An Index Or Bibliography

If you have found an article in an index or mentioned in a bibliography, and would like to know where you can access a full-text version, start with Hastings Law Library's e-journal finder. You can also search for the journal title in the Library Catalog, Lexis, or Westlaw.

San Francisco Public Library Non-Law Journals

If an article you have found is not in a law-related journal, and not in one of the non-law online resources at Hastings, you may want to search the online databases collection at the San Francisco Public Library. You can check to see if the journal issue you want is accessible from one of the databases provided by the San Francisco Public Library (SFPL), by searching their Periodical Finder. Or you can search through the various SFPL journal indexes. Any resident of California may apply for a SFPL Library card to get online full-text access.

Retrieve Articles Using Inter-Library Loan

If you are unable to find the article using UC Hastings and SFPL resources, you can search for an article using FirstSearch. Search the ArticleFirst and/or ECO databases, and then click on the ILL icon at the top of the page to request the article.

Finding Chinese Law in Subscription Databases

The Hastings Law Library subscribes to a number of Internet-accessible resources that may be useful in your research. All of our online resources are listed here. You can access all of them on campus. Most of them also allow remote access. If you are not on campus, and you click on the database, you will be directed to this screen. To use the database off-campus, enter your name as indicated on your Hastings ID and your ID barcode number.

The information in these databases are not comprehensive, and the English translations of the Chinese laws are not authoritative and not always accurate. This is the nature of English translations of foreign laws. When available, students should compare more than one English translation of a legal document.

LawInfoChina

This English language database is maintained by The Legal Information Center of Peking University. The database is under continuous development and the creators are attempting to make available the most important and most typical legal documents first, for instance, Cases are chosen to reflect both current and predicted future trends in Chinese legal practice. LawInfoChina contains editorially-enhanced versions of select cases, including the case background, facts, parties, trial and appellate court procedure, reasoning and law application, and the court decision. Although the English version only contains the table of contents of select Chinese Law Journals and official gazettes published by the Chinese central government bodies, the full text of many of these documents are available in Chinese.

This English language database is maintained by the iSinolaw Research Center in Hong Kong. It contains broad but incomplete coverage of the following: The Laws of the People’s Republic of China translated by the Legislative Affairs Commission of the National People’s Congress of China, State Council administrative regulations, rules or orders promulgated or approved by different departments under the State Council and institutions directly under the State Council such as Securities Regulatory Commission; local regulations and rules from various municipalities and provinces and Judicial interpretations from - Supreme People’s Court and the Supreme People’s Procuratorate and  China’s WTO Accession Documentation.

It includes the latest news and trends in US trade policy, including regulatory, legislative, and judicial developments, activities of the International Trade Commission, Departments of State, Treasury, and Commerce, World Trade Organization, and European Union. Each week there is usually a "Country Checklist" for China.

  • World Legal Information Institute: China - This is an excellent collection of links to most of the best websites for Chinese legal information on the Internet.
  • Ministry Of Foreign Affairs - Includes Foreign Policies, Official Activities, Speeches, Communiqués & Diplomatic Agenda.
  • Government White Papers - A collection of official Chinese government "White Papers" (in English) published by the Information Office of the State Council. Some of these may be useful research resources on various topics. State Council documents available online in English include: State Council Gazettes, Statistical Communiqués, White Papers, and Work Reports.
  • National People's Congress - The news website maintained by The National People's Congress, The People's Republic of China, is very good and is updated frequently. This website focuses on reporting all major missions and activities of the congress and its standing committee, releasing the laws, resolution/decisions and lists of appointments and removals passed by the standing committee. One interesting feature at this site is the Law Database. Using this database you can do quick research for Chinese statutes -- Just put the key word into "law database search" on the left side of the webpage. [Note: For some reason, this Law Database isn't always available.]
  • Chinese Civil & Commercial Law (CCCL) - The main content of this website is in Chinese while its English site offers a number of Chinese civil and commercial laws in English.
  • ChinaITLaw - Maintained by the Chinese Academy of Social Sciences, the Chinese Information Technology Law project aims to provide for free, the texts of China's IT regulations in Chinese and English.
  • CriminalLaw.com - Primarily in Chinese. The English version of this website publishes some introductory articles written in English regarding Chinese criminal law. It is a good research resource for Chinese criminal law, criminal procedure, and evidence.
  • Congressional-Executive Commission on China - This website was created by U.S. Congress in October 2000 with a legislative mandate [H.R. 4444, 106th Cong. (2000)] to monitor human rights and the development of the rule of law in China, and to submit an annual report to the President and the Congress. The commission consists of nine Senators, nine members of the House of Representatives, and five senior Administration officials appointed by the President. This website includes the annual reports of the commission, the topical papers, and the statements of panelists participating in the roundtables organized by the commission. A good place to track current legal issues in China.
  • China International Economic and Trade Arbitration Commission (CIETAC) - If you want to do business in China, you need to know about CIETAC. At this website you can find arbitration rules, Chinese laws, case analysis, and reports.
  • The Central People's Government of the People's Republic of China - This is an official website. It is a gateway to all Chinese government information and services, and an interactive channel between government and the public. It includes laws and regulations, the Constitution, official publications (such as State Council Gazettes, Statistical Communiqués, White Papers, & Work Reports), and the searchable China Legislative Information Network System.
  • China's Ministry of Justice website - It includes information on legislative developments, judicial assistance, legal aid, and a Chinese law search system.

  • Bilingual Laws Information System - The U.S. Government maintains this free online database containing:
    • the statute laws of Hong Kong in English and Chinese
    • constitutional and other relevant documents, including the constitution of the PRC, the Sino-British Joint Declaration, the Basic Law of the HKSAR and the PRC national laws that apply in the HKSAR

  • Wei Luo of the Internet Chinese legal Research Center maintains a webpage of annotated links to Chinese Law Resources on the Internet, including databases of China law mostly in Chinese with limited availability of English translations. This site is in English, but is more useful for students who read Chinese.
  • Foreign Law Guide: China - This guide to foreign law is available in the Hastings library in print and online. Use the pull-down menu at the top of the page and select "China, People's Republic of" to find useful information about China's legal history, legislation, and judicial system.
